REGULATIONS OF THE BACKSTAGE CARD DISCOUNT PROGRAM

1. GENERAL PROVISIONS

1.1. The regulations define the conditions of the BACKSTAGE CARD discount program (hereinafter referred to as the "Program").

1.2. The Organizer of the Program is Mokotoska sp. z o.o. based in Warsaw, ul. Mokotowska 58/2A, 00-534 Warsaw, registered in the register of entrepreneurs maintained by the District Court for the capital city of Warsaw in Warsaw, XII Economic Department of the National Court Register under number KRS: 0000455516, NIP: 7010375082, REGON: 146604503, with a share capital of 200,000.00 PLN, hereinafter referred to as the "Organizer."

1.3. The Program is aimed at customers (hereinafter: "Participants") making purchases of goods at the Organizer's Store located at ul. Mokotowska 58 in Warsaw (hereinafter the "Store") or through the Organizer's websites https://promakeupshop.com or https://sklep.mokotowska58.com/pl/.

1.4. The goal of the Program is to enable the purchase of goods and services selected by the Organizer on preferential terms and to inform about new products, current offers, and promotions for Professionals. Participation in the Program may also be associated with the right to participate in promotions intended for Participants, related to the indicated goods or services, or other circumstances, at the Organizer's discretion. The public or individual nature of such promotions depends solely on the Organizer's decision.

1.5. These regulations are binding on the Organizer and Participants from the moment of their announcement.

1.6. These Regulations will be considered accepted by the Participant by submitting a declaration in the Application for Joining the Program available at https://backstagecard.pl/, and for Participants who joined the Program before its announcement, after the lapse of 7 days from the date of notifying those Participants of the change, unless the given Participant refused to accept the Regulations, thereby terminating their participation in the Program.

2. JOINING THE PROGRAM

2.1. Anyone who meets the participation conditions may join the Program.

2.2. Only a person who:

2.2.1. has full capacity to perform legal acts and

2.2.2. fill out the Application Form (hereinafter referred to as the “Application”) and
   

2.2.3.    demonstrate to the Organizer that they are a professional (hereinafter referred to as the “Professional”) within the meaning of the Regulations.
   

2.3.    The Organizer may grant Professional status under the Regulations exclusively to Makeup Artists and Stylists actively working for theaters, film, television, fashion shows, circus, opera, cabaret, vaudeville, photo sessions, Photography Studios, Beauty Salons, Hairdressing Salons, Transformation Salons, Graduates and Students of makeup and cosmetology schools, Lecturers of makeup and cosmetology schools, Set Designers, Costume Designers, Dancers, Singers, Actors, Television Presenters, Beauty Bloggers, and Vloggers, Drag queens, Graduates of courses and training organized in the field of makeup by professional makeup schools.
   

2.4.    To demonstrate Professional status, the following is required to present to the Organizer a copy of at least two documents from the list below:
    - portfolio (also in electronic form, including website address); portfolio documented on the Film Polski website - http://www.filmpolski.pl or on the IMDb website - https://www.imdb.com/ does not require other documents
    - excerpt, copy, or scan of the entry in the CEIDG (Central Register and Information on Economic Activity) or KRS (National Court Register) covering the PKD relevant to activities mentioned in point 2.3,
    a) link to the artistic agency representing the Professional,
    b) certificate from the artistic agency representing the Professional,
    c) published sessions signed with the Professional's name,
    d) discount cards from other professional cosmetic brands
    e) Professional diploma i.e. diploma of graduation from a Makeup or Characterization school or Acting school or other school proving belonging to the group of Professionals mentioned above,
    f) reference letter confirming employment related to the work of a Professional (from the last 12 months from the date of submitting the application).
   

2.5.    A person interested in joining the Program must submit a properly completed Application, along with a complete set of documents listed in point 2.4 directly on the website https://backstagecard.pl/, owned by MOKOTOSKA SP. Z O O.
   

2.6.    The Application should be filled out completely, legibly, and truthfully. The Organizer will only accept an Application that has been properly completed and contains all required data, including the Participant's consent to the processing of their personal data related to the Program. The Organizer reserves the right not to accept an Application in justified cases, such as incomplete or incorrect completion, false data, or in the case of a repeated application for Participant status despite already having such status or earlier exclusion from the Program.
   

2.7.    The Organizer will consider the application immediately after its receipt.

   

3.    BACKSTAGE CARD NUMBER
   

3.1.    Each person who fills out the Application and meets the conditions for joining the "BACKSTAGE CARD" program is assigned by the Organizer an individual program participant number referred to hereinafter as the BACKSTAGE CARD Number or abbreviated as BACKSTAGE CARD (formerly called "Backstage Card").
   

3.2.    The Organizer will inform the Participant by email about the assigned BACKSTAGE CARD Number or inform about the negative consideration of the application if it does not meet the criteria mentioned in points 2.3 and 2.5 above.
   

3.3.    If the Participant already has an existing and active account in the online store sklep.mokotowska58.com, the Organizer assigns and activates the BACKSTAGE CARD Number in the Participant's customer account in the Online Store.
   

3.4.    If the Participant did not previously have and is just establishing or will establish an account in the online store promakeupshop.com or in the online store sklep.mokotowska58.com, it is required for the Participant to enter the assigned BACKSTAGE CARD Number when establishing the account in the Online Store. Activation of the BACKSTAGE CARD in the store account will be carried out immediately by the Organizer. The Participant will be informed of the activation by email.

3.5.    Unless the Organizer decides otherwise, holders of the BACKSTAGE CARD Number receive a discount of 20% on goods and services from selected Partner Brands available in the Organizer's offer. The current list of partner brands is available on the Organizer's website at https://backstagecard.pl.
   

3.6.    The BACKSTAGE CARD Number is valid only in:
   

3.6.1.    PRO ONLY MAKEUP STORE located at ul. Mokotowska 58, 00-534 Warsaw,
   

3.6.2.    for orders placed in the Online Store located at https://promakeupshop.com/,
   

3.6.3.    for orders placed in the Online Store located at https://promakeupshop.com or https://sklep.mokotowska58.com/,
   

3.6.4.    for orders placed for equipment rental available in the BACKSTAGE4RENT rental offer (https://backstage4rent.pl/),
   

3.7.    Transportation, delivery, as well as assembly and disassembly services are not included in the BACKSTAGE CARD discount.
   

3.8.    The BACKSTAGE CARD Number assigned to a natural person is personal and may not be lent or transferred by the Participant to others.
   

3.9.    The BACKSTAGE CARD Number assigned to a legal entity is not personal but using the discount requires confirmation of the rights for the person using the BACKSTAGE CARD Number by the Program Participant each time. The discount for a legal entity also requires that the orders be placed by a person authorized or empowered to represent the legal entity and that they be placed in the name of that legal entity.
   

3.10.    The Participant is obligated to immediately notify the Organizer of any change in their personal data. In the event of failure to provide such notification, the Organizer shall not be liable for delays or lack of action caused by outdated data.
   

3.11.    Discounts obtained by the Participant under the Program may not be sold, transferred, or otherwise disposed of by the Participant to other persons. Discounts may also not be exchanged for cash or be the subject of other activities, except as specified in these Regulations.
   

3.12.    The Organizer may deactivate or suspend the BACKSTAGE CARD Number in the event of using the Program contrary to the Regulations.

   

4.    LOSS OF PROGRAM PARTICIPANT STATUS
   

4.1.    The Organizer may exclude a Participant from the Program with immediate effect if the Participant:
   

4.1.1.    does not comply with the Regulations, in particular providing false data or falsely representing themselves as another person to the Organizer,
   

4.1.2.    has requested to cease processing their personal data or has filed an objection regarding their processing.
   

4.2.    Membership in the program may be terminated by the Organizer if the Participant has not made purchases under the Program for a period of at least 18 months.
   

4.3.    Participation in the Program expires in the event of the Participant's death, as well as in case of termination of the Program (point 5).
   

4.4.    In the event of the Participant's exclusion, the Organizer is entitled to withdraw the User from the Program. Exclusion of the Participant from the Program does not entitle the Participant to claim compensation or restitution in any form other than expressly provided for in the Regulations.
   

4.5.    The Participant may withdraw from participation in the Program at any time by submitting a suitable statement in writing or by email to the address info@backstagecard.pl. Upon delivery of such a statement to the Organizer, the Participant is withdrawn from the Program and loses the rights granted to them.

   

5.    TERMINATION OF THE PROGRAM. AMENDMENTS TO THE REGULATIONS
   

5.1.    The Organizer reserves the right to suspend or terminate the Program at any time. In such a case, the Organizer is obliged to place appropriate information in the Store as well as on the website www.promakeupstore.com. Additionally, in the event of suspension or termination of the Program, the Participant will receive appropriate information by email.
   

5.2.    Termination of the Program means that all rights of the Participants related to Participation in the Program expire.
   

5.3.    The Organizer is entitled to make changes to the Regulations at any time during the Program.
   

5.4.    In the event of changes to the Regulations, the Organizer will provide a consolidated text of the amended Regulations in the Store and on the websites promakeupshop.com, sklep.mokotowska58.com, and https://backstagecard.pl/.
   

5.5.    Use of the BACKSTAGE CARD Number after amendments to the Regulations signifies acceptance of the changes.
   

5.6.    Changes to the Program Regulations do not entitle the Participant to claim compensation or restitution in any form.
   

5.7.    Physical BACKSTAGE CARDs - issued for the BACKSTAGE CARD Program prior to the date of announcing changes in the Program - do not lose their validity but are no longer required to confirm participation in the Program by the Participant.

   

6.    PERSONAL DATA PROTECTION
   

6.1.    By joining the Program, the Participant voluntarily consents to the processing of their personal data by the Organizer for purposes related to the Program. The consent is given through a statement made when filling out the Application and sending it to the Organizer. Personal data are subject to protection provided in the Act of August 29, 1997 on personal data protection.
   

6.2.    The Program Participant has the right to access their personal data and modify them. The Organizer ensures each Participant the right to control the processing of their data.
   

6.3.    The data of the program participant are processed in accordance with the Privacy Policy.
   

6.4.    The Participant will continuously receive information via email (electronic mail) about promotional and commercial actions conducted by the Organizer.

   

7.    ACCEPTANCE AND IMPLEMENTATION OF REGULATIONS
   

7.1.    These Regulations will be considered accepted by the Participant by making a suitable statement when submitting the Application at https://backstagecard.pl/aplikacja/.
   

7.2.    The Organizer is released from all liability for any consequences, indirect or direct, of any irregularities in the operation of the Program. However, the Organizer will make every effort to ensure that the Participant, in case of irregularities in the operation of the Program, can benefit from discounts.

   

8.    FINAL PROVISIONS
   

8.1.    Any objections related to the Program, in particular the granted discount, should be reported by Participants immediately, by mail or via email to the address specified in the Regulations (point 1.2) or by email to info@backstagecard.pl.
   

8.2.    These Regulations come into force on November 27, 2024, and completely replace the previous Regulations of February 1, 2024.
